Travel Participation Terms and Conditions



These terms and conditions (“Terms and Conditions”) govern the relationship between The Paradise Lounge LLC d/b/a The Paradise Lounge (“TPL” and/or “we/us/our”) and you, the purchaser or traveler (“Client” and “passenger” and “you/your”). By planning travel with TPL, you agree to be bound by these terms. 

 

  1. USE OF TPL SERVICES, ACCESS AND INFORMATION FOR TRAVEL BOOKINGS

 

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with TPL. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with TPL and its Suppliers, and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.

 

TPL is not liable or responsible for any arrangements made independently of TPL. TPL assumes no responsibility for costs or fees you incur for independent arrangements not booked through TPL, inclusive of, but not limited to, airline, hotel, excursion, and travel protection related charges. If you make your own flight arrangements, TPL is not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates, and cannot assist you with any schedule changes or delays related to air reservations you have made on your own arrangement. It may not be possible to earn frequent flyer or other loyalty points for reservations on your itinerary. With limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements made by TPL.

 

  1. RIGHT TO CORRECT ERRORS AND OFFERS SUBJECT TO AVAILABILITY 

We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. You are advised to confirm reservations well in advance of your anticipated dates of travel to avoid disappointment, increases in fares and additional late booking fees.

  1. RESERVATIONS

 

Client Portal

Each Traveler shall have a designated Client Portal, which allows the Traveler to access billing 24/7.

 

Identification

Guests are required to make reservations in the full name that is listed on their government document they will use for travel. If you need to make any changes to a name after travel documents have been issued, clients will be responsible for all name change fees, if applicable.

 

Deposits

All reservations must be accompanied by a non-refundable deposit to The Paradise Lounge. There are no exceptions to this deposit fee. This information is shared on the website and sales order form prior to your agreement to book the traveler’s destination. No travel arrangements will be booked unless the deposit is paid.

 

Passports

Passengers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months after the date of travel. Some countries require a full blank “VISA” page in the passport for stamping purposes. Any information provided on travel description pertains to US citizens only. Non-US citizens should check with the respective consulate of the country(s) to be visited for current entry requirements. We strongly suggest all cruise passengers have a valid passport in their possession while cruising.

 

  1. PAYMENTS, CANCELLATIONS, RESERVATION CHANGES, AND REFUNDS

 

You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through TPL. By submitting your order form, EXCEPTING IN CASES 0F FRAUD, YOU AGREE NOT T0 FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF TPL  INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF TPL. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, TPL RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.

Payments

 

All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking. Reservations can be paid for in full at the time of booking. If the reservation is not paid in full, monthly installment payments are required. Monthly installment payments that are 60 days past due with no payments will be canceled automatically with no refunds, and deposits shall be forfeited. A fee of $250 will apply to reinstate your reservation if space is still available.

 

Refunds

The Paradise Lounge does not issue refunds for any reason. We sign agreements with outside parties, including lodging accommodations, tour operators, airlines, etc., and must abide by their terms, conditions, and penalties. Travelers will be advised to submit a travel claim for reimbursement. If a traveler has purchased an insurance policy, there should be no conflict with obtaining reimbursement.

 

Reinstatement of Reservation

If your travel reservations have been canceled, and you notify us within 14 days that you want to reinstate your reservations, a service reinstatement fee of $250 for international tours will be added to your invoice and must be paid in advance in order to apply for reconfirmation of services.

 

Cancellation by the Client

Once reservations have been made, cancellations will only be accepted in writing. Email your cancellation request to [email protected] with your invoice number, full name, and date of travel. If you do not receive an acknowledgment within 48 hours, please call 843-561-9180 to ensure your information was received. All payments are non-refundable and non-transferrable and will be forfeited by the client immediately upon cancellation.  

 

 Reservation Changes

If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Certain bookings may not be able to be changed, and you will be responsible for any increases in cost imposed as well as any change fees. Traveler will incur a $250 charge plus any additional supplier fees. This includes name changes and removal of any services such as optional tours and transfers. Please note that name changes to airline reservations require The Paradise Lounge to fully cancel and rebook a new traveler. Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the Company. All unused services are non-refundable. All requests for changes to a booking must be made in writing to TPL. Prices are based on contract rates, therefore you will not be entitled to any refund for any unused portion of travel.  

 

  1. TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS 

It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/ and examples include DHS-designated enhanced driver’s license, US passport, or a foreign government passport. 

Certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation, and you are responsible to make TPL aware when traveling on a passport from a country other than the United States of America. TPL neither controls nor warrants the issuance of visas or approval of visa waivers related to your travel. Should a visa not be issued, TPL is not responsible for lost payments made toward your trip. Please note that rules of each country regarding entry and exit may change at any time.

 Children and infants may also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov for additional information. The U.S. Customs and Border Protection Agency requires that for groups of children under age 19 arriving to the United States by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult or group leader in writing. 

The name, date of birth and gender that appears on the identification card must exactly match the same data that is listed on your tickets and booking records. You acknowledge that it is your responsibility to ensure that the information on your tickets and confirmations is accurate. Any discrepancy between your reservation and your travel documentation may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss your flight, and any subsequent scheduled travel bookings on cruises and tours. 

WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT TPL IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. IF YOU HAVE NOT NOTIFIED US OF NECESSARY CORRECTIONS TO YOUR RESERVATION WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR TRAVEL DOCUMENTS, TPL BEARS NO RESPONSIBILITY FOR ANY ADDITIONAL COSTS ASSOCIATED WITH MAKING NECESSARY CORRECTIONS.

 

  1. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS 

Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for 

entry and exit requirements. You can visit the US State Department Website for further information about these requirements. See, https://travel.state.gov/content/travel.html. We do not inquire about an individual’s criminal record in the interest of respecting our Clients’ privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record or with judgements for unpaid child support should review current entry requirements.   1. TRAVEL INSURANCE

Trip insurance is highly recommended for all travelers.TPL OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF CLIENT’S ITINERARY TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION AND CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES. Without appropriate travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, your trip will not be refunded. TPL’s cancellation penalties will apply resulting in the loss of the full cost of Client’s travel booking and related costs. The purchase of travel insurance is not required in order to purchase any other product or service offered by TPL, however if you decline to purchase insurance, TPL will require that you execute an insurance waiver. TPL is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. An additional charge applies for any travel insurance selected. It is your responsibility to know what your insurance policy covers, and to put alternative coverage in place, if you wish to insure for conditions that are excluded by your policy. TPL CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR A CLAIM MADE UNDER THE INSURER’S POLICY AND MAKES NO REPRESENTATIONS ABOUT THE EXTENT OF COVERAGE FOR ANY POLICY IT MAY OFFER OR QUOTE



  1. TRAVELER WITH DISABILITIES

To fully enjoy your trip with The Paradise Lounge, we recommend that you select a trip that is suitable for your physical capabilities. Tour participants requiring any form of assistance, including travelers with physical disabilities, sight or hearing impairments, are required to notify The Paradise Lounge prior to reservation for review of our agreement. Additionally, the tour participant must be accompanied by an individual responsible for providing those services. Tour managers, guides, drivers, or other tour, hotel, ship personnel are not able to provide such assistance. In order to participate in escorted tours, passengers must be able to understand and follow instructions given by the Tour Director at all times; both for the successful operation of the tour as well as for their personal safety. The Paradise Lounge reserves the right to reject participation or remove any individual from a tour if notification was not provided and/or when, in our sole discretion, continued participation would significantly hinder the services to be provided to all guests. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the sole responsibility of the passenger. Escorted tours are fast-paced, often requiring lengthy walks over uneven terrain. In the interest of group harmony, clients should be able to maintain the pace of the tour. Clients with special needs may be better served independently. The Paradise Lounge can suggest touring options based upon specific requirements.

 

  1. AIRLINE ACCOMMODATIONS

Your airline ticket is a contract between you and the air carrier, even if you purchase through TPL. If you purchase air travel through TPL, you acknowledge and agree that TPL does not have the right to control the operations of independent airlines, and agree that TPL is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations. 

You understand and agree that TPL functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation’s regulations. Because TPL does not hold or handle client funds, you understand and agree that any refund for canceled or delayed flights, baggage fees or seat assignments must come directly from the airline and not from TPL. 

TPL shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in 

price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. 

Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise. 

Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. 

By checking in for a flight, tour or cruise, you may be agreeing to additional terms and conditions imposed by the Supplier. If you have authorized TPL to check you in for any component of your trip, that you take full responsibility for agreeing to and complying with the Supplier’s terms and conditions of check-in. 

Frequent Flyer mileage accrual is at the discretion of the airline(s). TPL has no liability if accural of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates. 

Seat assignments are not guaranteed even after they are assigned, and TPL has no control over airline seat assignments. Most airlines charge a fee to pre book a seat.

 

Schedule Changes

In the event of an airline schedule change, The Paradise Lounge will make every effort to inform passengers of the schedule change and new flight schedule prior to departure. The Paradise Lounge is not responsible for schedule changes including, when applicable, changes in routing and/or the number of stops in the itinerary. 

 

The Paradise Lounge is unable to provide compensation for schedule changes, seat assignment modifications, or cancellations implemented by an airline. In the event of any change in flight itinerary made directly between passengers and their airline, it is the passengers’ responsibility to advise The Paradise Lounge of amended flight details in writing at [email protected]. The Paradise Lounge cannot be held responsible for land services, including arrival and/or departure transfers, if flights are changed without its knowledge.

 

  1. HOTEL ACCOMODATIONS

 

All rooms requested are standard twin-bedded (two single beds) rooms with private facilities unless you have specifically requested a king/double sized bed. Please understand that although we will make a bed type request on your behalf, bed types are subject to availability. Room selection in all cases is strictly at the discretion of the hotel’s management on a run-of-house basis. Triple and quad occupancy rooms consist of two beds. Some single rooms are smaller than a standard room size. The number of persons accommodated does not dictate the room size. Although available at most 4 and 5-star hotels, use of air-conditioning abroad differs greatly from the United States. Many European hotels were built before central air-conditioning was introduced. Air-conditioning is often shut down at night and from the end until the start of the summer months. All hotel rates are based on The Paradise Lounge agreements with its suppliers and are not negotiable. Hotel check-in time is generally not before 3:00 p.m. and check-out time is prior to noon. Please be sure that adequate arrangements for accommodations have been taken into consideration when a late-night flight is being used. We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations.

 

  1. IMMUNIZATIONS AND HEALTH SCREENINGS 

You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. TPL shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the Center for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues related to travel.

The individual will be allowed to resume group travel. All costs associated with medical treatment and related expenses such as additional hotel nights or transportation not included in the original itinerary, will necessarily be borne by the passenger. Please note that some countries may require aircraft cabin insecticide treatment for inbound foreign flights.   1. RISKS AND SAFETY 

Travel to certain destinations may involve greater risk than others. TPL urges Clients to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/ BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, TPL DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK. In the event of emergent health or safety concerns, once TPL has investigated the prevailing situation, TPL shall have the sole and absolute discretion whether to proceed with any TPL escorted trip or private departure, or to make alterations to the itinerary.

  1. HAZARDOUS MATERIALS 

Federal law prohibits passengers from bringing hazardous materials on the aircraft. (1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals. (2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary.   1. INSECTICIDE NOTICE 

We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

 

  1. ASSUMPTION OF RISKS

 

Release from Liability

The Paradise Lounge, its shareholders, directors, officers, employees, and affiliates, (collectively “The Paradise Lounge”) does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. As a result, The Paradise Lounge is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party. Without limitation, The Paradise Lounge is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as swimming, kayaking, sailing, canoeing, rafting, hiking, walking, bicycling, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics or the threat thereof or for any other cause beyond the direct control of The Paradise Lounge. In addition, I release The Paradise Lounge from its own negligence and assume all risk thereof.

 

Assumption of Risk

I acknowledge and agree that the nature of travel such as this event poses certain inherent dangers or hazardous activities, with a risk of illness, injury or death however caused, arising from, or in any way related to participation in this event. I am aware that weather conditions may be severe, adverse, and/or unpleasant. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating in the trip. In order to partake of the enjoyment and excitement of this trip I am willing to accept the risks and uncertainty involved as being an integral part of my adventure. I hereby accept and assume full responsibility for any and all risks of illness, injury, or death and of the negligence of The Paradise Lounge and agree to hold harmless and release The Paradise Lounge from claims of third-party negligence. I understand the physical requirements of the activity in which I will be participating, and currently have no known physical, medical, or mental condition which would impair my ability to participate in this tour or my safety in this activity, and I am willing to assume all risks that may be created, directly or indirectly, by any such condition. I knowingly and voluntarily, accept, and assume responsibility for, each of these risks and dangers, and all other risks and dangers that could arise out of, or occur, and further RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE The Paradise Lounge, its agents, employees, contractors, and volunteers (collectively, “Releasees”), from and for any liability resulting from any personal injury, accident, or illness (including death), and/or property loss, however caused, arising from, or in any way related to, Participant’s participation in the Event, except for those caused by the willful misconduct, gross negligence, or intentional torts of other persons and companies known or unknown, or of willful or criminal conduct of third parties. I hereby authorize The Paradise Lounge or my local ground handler or others to arrange for any emergency medical treatment and hospitalization as may be necessary for me because of participation in this activity without my further consent.

 

  1. BINDING ARBITRATION

 

I agree that any dispute concerning, relating, or referring to this Agreement, the brochure, or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§1-16, either according to the then existing Commercial Rules of the American Arbitration Association (AAA) or pursuant to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) South Carolina law and will take place in Charleston, SC. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable. Please understand that by agreeing to these terms and conditions, you (and we) are waiving our right to a trial by jury.

  1. FORCE MAJEURE 

TPL will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of TPL. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS. In addition, each of TPL’s Suppliers have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier pursuant to their policies, although TPL shall use its reasonable efforts to secure reimbursement for you where possible.

  1. VOLUNTARY PARTICIPATION

 

I acknowledge that I have voluntarily applied to participate in the trip designated on this application (or a trip which I may change to) and that I have read the description of the trip as it appears in the current The Paradise Lounge website relating to the trip, together with all information contained in this application. I am voluntarily participating in this trip with knowledge of the hazards involved.

 

  1. KNOWING AND VOLUNTARY EXECUTION

 

I have carefully read these Terms and Conditions and the booking information sections of this document, and fully understand its contents. I am aware that this is a release of liability and a contract between myself and The Paradise Lounge and agree of my own free will. By signing, I agree to these Travel Terms & Conditions and The Paradise Lounge Release from Liability, Assumption of Risk and Binding Arbitration Clause for myself, each member of my traveling party, and any minor children accompanying me.

 

  1. PHOTOGENIC RELEASE

 

Photographs and videos taken by The Paradise Lounge representatives while on trips/vacations are the property of The Paradise Lounge and may be used in promotional or commercial materials without payment of any compensation to participants. Any traveler who does not wish to have their photograph or video footage used in promotional material MUST advise The Paradise Lounge in writing no later than the trip/vacation final payment due date.

 

  1. USE OF WEBSITE

 

Your use of www.paradiseloungetravel.com constitutes your agreement to all terms, conditions, and notices contained herein. The information, products, and services published on this website may include inaccuracies or typographical errors. Changes are periodically made to the information which appears here. The Paradise Lounge may make improvements or changes on this website at any time. In no event shall The Paradise Lounge be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, the use of this website, or for any information, products, and services obtained through this website, or otherwise arising out of the use of this website.



  1. COVID-19 WAIVER OF LIABILITY

 

In Spring 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a worldwide pandemic. The Center for Disease Control (CDC) issued several preventative measures to combat the virus, such as frequent hand washing, wearing a mask or face covering, and keeping at least 6 feet away from others. If contracted, this virus has the ability to cause the traveler serious and severe illness. For more information on the COVID-19 virus, please visit the CDC website at www.cdc.gov. The client understands and agrees to the following:

 

  • COVID-19 is a highly contagious virus that can be spread via person-to-person contact;

 

  • After reasonable inquiry, The Paradise Lounge provided me with the best available information regarding the pandemic-protective policies and practices of the vendors and suppliers in my travel itinerary;

 

  • Supplier(s) of The Paradise Lounge may have policies in place to help prevent the spread of COVID-19. The Paradise Lounge is not the drafter or holder of those policies and I understand that these policies can change at any time;

 

  • I understand that the supplier(s) may not apply those policies as diligently as the policies suggest and even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate;

 

  • I understand that each state/country institutes its own pandemic protective policies and regulations. I further understand that I am responsible for knowing, understanding, and abiding by the pandemic protective policies and procedures regarding COVID-19 of all state(s)/country(ies) listed in my travel itinerary, including any policy updates. I also understand that I may be denied entry into the country for reasons within or outside of my control;

 

  • I understand that by traveling, I may be subject to voluntary or involuntary quarantine either at home or in the traveled location(s);

 

  • I am responsible for knowing, understanding, and abiding by the pandemic protective policies and procedures regarding COVID-19 of all vendors used in my travel itinerary, including any policy updates.

 

With full awareness and appreciation of the risks involved, I, for myself, and on behalf of my traveling companions, including, but not limited to, my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, assume all risks of travel and hereby forever hold harmless, waive, discharge, and release The Paradise Lounge, its officers, agents, independent contractors, affiliates, employees, successors, host agency, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering with The Paradise Lounge.

 

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury or harm, death, loss of use, monetary loss, or any other injury from or related to my use of The Paradise Lounge services, or the services of travel The Paradise Lounge suppliers or vendors, specifically related to COVID-19.

 

This waiver will remain effective until laws and mandates relevant to COVID-19 are lifted.

 

  1. REFUSAL OF SERVICE

 

Travel Agent and Service Provider have the right to refuse service to any client at any time for any lawful reason whatsoever; it shall be at their sole discretion.

 

  1. ATTORNEY’S FEES

 

The said parties agree that in the event that a dispute arises relating to this contract, the prevailing party in any arbitration or court proceeding will be entitled to recover an award of its reasonable attorney, expert witness fees, cost and pre- and/or post-judgment interest.

 

  1. WAIVER OF RIGHT TO CHARGEBACK

 

 Client(s) waive any right to charge-back or disputes of payments willfully made by the clients to The Paradise Lounge; or Tyra Thompson or any other agent(s) representing the same. If the client initiates a charge-back or dispute, the client agrees to pay the Service Provider or the Travel Agent (to whom said charge-back or dispute is initiated against) at a fee of $100 plus any legal fees, attorney fees, the outstanding balance of the invoice, any overdraft fees, and penalties rendered by banking institutions, and/or all other relief provided for by the law.

 

  1. CLIENT CONDUCT

 Each participant in any trip escorted by TPL is expected to act responsibly and adhere to all behavior guidelines established by TPL and our Suppliers, including adhering to dress codes at 

religious or cultural sites, or Supplier dress codes. TPL and all local Suppliers reserve the right to remove you from any facility, hotel or resort property, tour location or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other clients on any element of your trip, or interferes with the operation or security of the places you visit. In any such case, there will be no refund. When you book with TPL, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify TPL for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip. You agree not to hold TPL or any of its related entities liable for any actions taken under these terms and conditions. Baggage and personal effects are at all times the sole responsibility of the participant. Any transportation, possession or use of illegal drugs will result in immediate termination of your trip and may result in prosecution by law enforcement authorities. You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over the counter drugs) for all countries and states you are visiting. Laws may require you to carry a prescription from your doctor.

 

  1. GROUP HARMONY

 

To ensure the desired group synergy, The Paradise Lounge reserves the right to accept, reject, or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to, individuals who are intoxicated and/or under the influence of drugs leading to a negative experience for the remainder of the group. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will necessarily be borne by the passenger. All unused services are non-refundable.

 

  1. ROOMMATE MATCHING

 

Roommate matching is available for our International Tours. When making your reservations, please select “double occupancy.” Complete the roommate match survey at [roommate matching survey link]. You will be matched with a roommate once you have paid more than 75% of the balance of your travel reservations and provided the person you will be matched with has also paid 75% of his/her balance. Travelers who opt into roommate matching agree to share a room accommodation for the entirety of the trip. Any conflict between Travelers who have room matched should be resolved appropriately. If Travelers who have agreed to room match have a conflict that is unable to be resolved and requires new rooming assignments, each Traveler involved will be personally responsible for finding their own and separate accommodations. The Paradise Lounge, under any circumstances, will not be responsible for additional accommodations.

 

  1. RESERVATION OF RIGHTS AND CHANGES TO THESE TERMS 

We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms will be provided to Clients, will be posted on our website and are effective immediately on posting. 

  1. GENERAL 

The laws of the State of South Carolina govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Berkeley County, South Carolina in all disputes arising out of or relating to travel bookings with TPL. Any claim against TPL must be brought within 12 months after the date of the completion of the trip and not later. TPL shall not in any case be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. You agree that you may only bring claims in your individual capacity and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. You expressly agree to waive and forego any and all rights to bring any such class actions, purported or proposed class actions, or representative actions. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect. These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and TPL with respect to travel bookings made with TPL by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and TPL with respect to communications with TPL. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
